BUMD Bylaw Ratification Meeting only Attended by 41 DPRD Members

The attitude of Jakarta Council (DPRD) members after the 2014 legislative election seems getting lazy. It can be seen from the quiet meeting of ratification on bylaw about city-owned enterprise (BUMD) of PT Food Station Tjipinang Jaya, Friday (4/25), which only attended by 41 out of 94 total members.

Such amount is actually not quorum to ratify bylaw, because the meeting is supposed to be attended by at least 2/3 members or about 61 people. And based on beritajakarta.com observations, out of 41 members signed the absent list, only 30 members really attended the meeting led by Vice DPRD Chairman, Triwisaksana. Even so, the official still asked for agreement to the present members about the ratification.

“Is the ratification on bylaw about PT Food Station Tjipinang Jaya BUMD approved?” asked Triwisaksana, which then agreed by the present members.

TransJakarta Officially a BUMD Now

Before that, council member from Democratic Party, Johny Wenas Polii, had addressed his opinion on the bylaw ratification. According to him, his fraction suggests for the bylaw to include PT Food Station Tjipinang Jaya as a food security buffer in Jakarta, not merely to reach benefit.

“We ask the council to remind legal bureau for this bylaw to state PT Food Station Tjipinang Jaya functioned as food security buffer, not rice only,” he said.

The bylaw itself consists of 8 chapters and 13 verses, which one of its substances regulated about company’s basic capital that is determined for as much as Rp 1.5 trillion. PT Food Station Tjipinang Jaya was actually established in 1968 based on Governor Decision No. Ea.18/1/38/68 dated September 3, 1968. It was then strengthened with ratification by Ministry of Justice No. YA.5/120/3 dated April 1, 1975.

If examined deeper, PT Food Station Tjipinang Jaya is currently not a city-owned enterprise in terms of de jure, but already is in terms of de facto. Such a thing is in accordance to article 177 Act No. 32/2004 about Regional Government which states that regional government can own BUMD which establishment through bylaw.

With the ratification of this bylaw, Jakarta Provincial Government owns majority of stocks for 74.6 percent. Besides that, PT Food Station Tjipinang Jaya can implement logistic business function that covers trading, shopping center, rice procurement, crops, etc.
