Jakarta City Council's Special Committee on Expediting the Handover of Social and Public Facilities has issued several recommendations to speed up developers' fulfillment of their obligations to hand over social and public facilities to the Jakarta Provincial Government.
Developers' commitments must be backed by verifiable fulfillment of their obligations
The recommendations cover three areas: regulations and policies, data and monitoring systems, and implementation and enforcement.
Commission A Chair Sees Improvement in Public Facilities HandoverHilda Kusuma Dewi, a member of the Jakarta City Council's Special Committee on Social and Public Facilities, urged Jakarta Governor Pramono Anung to promptly issue implementing regulations on the management of regional government assets.
The committee also called on the Regional Asset Management Agency (BPAD) to lead a reconciliation of data on outstanding obligations at 1,323 locations, ensuring that claims against developers are based on accurate information.
"Developers' commitments must be backed by verifiable fulfillment of their obligations. Handover obligations must be supported by handover certificates, while facility provision must be verified against the relevant permits and agreements," Hilda said Wednesday (10/14).
The committee also called for priority cases to be resolved, including delayed school and road construction projects, and for the use of land that has already been handed over but is still being used for commercial activities to be brought under control.
"Obligations involving land handover, construction work, and facility provision must also be recorded separately as a basis for pursuing claims," she added.
To ensure the recommendations are followed up, the committee proposed establishing a follow-up and enforcement special committee to oversee the fulfillment of social and public facility obligations.
The proposed committee is expected to monitor the resolution of developers' outstanding obligations, protect the region's rights, and ensure the facilities can be used by the public.
"These recommendations will serve as the basis for follow-up action by the Jakarta Provincial Government and oversight by the City Council to ensure social and public facility obligations are fulfilled," Hilda noted.
