Nakertrans Agency Issues Circular Regarding Payment of THR

The Jakarta Manpower, Transmigration, and Energy (Nakertrans) Agency Head Andri Yansyah issued the Circular Letter of Manpower Minister number M/1/HK.04/IV/2022 on the 2022 Eid al-Fitr THR (holiday bonus) Payment for Workers/Labourers in the Company and Circular Letter of Manpower, Transmigration, and Energy Agency number e-0005/SE/2022 on 2022 Religious THR Payment

THR cannot be paid in installments

According to him, every company is obliged to pay THR to its workers in full no later than seven days before Eid al-Fitr 1443 Hijri.

"THR cannot be paid in installments, where it was only allowed in 2020 and 2021. Moreover, economic conditions have improved as Covid-19 cases decline," he stated, Tuesday (4/26).

He explained that the minister's circular also stipulates the establishment of THR command posts in each province to anticipate complaints arising in the implementation of religious THR payments in 2022.

To follow up on it, his agency had set up THR command posts in five offices and sub-agencies in Jakarta to serve workers and entrepreneurs who want to consult or file complaints regarding the 2022 THR payment.

Consultations and complaints can be reported via the consultation Whatsapp number (0812 8459 5934) and also Whatsapp complaints (0812 8633 9649). The service can also be accessed by the public online through the site https://poskothr.kemnaker.go.id.

"We conduct monitoring based on the information and reports received, including joint monitoring with the Tripartite and the Wage Council," he explained.

He asserted that THR is a worker's right that must be paid by employers ahead of Religious Holidays as regulated in Government Regulation number 36/2021 on Wages in conjunction with Manpower Minister Regulation number 6/2016 on Religious Holiday Allowances for Workers/Labourers in Companies.

It must be given to workers with a certain time work agreement (PKWT) or an indefinite work agreement (PKWTT) who have worked for one month continuously or more.

For workers who have worked for one month continuously but less than 12 months, the amount of THR is given proportionally following the calculation of the period of service divided by 12 times one month's wages.

"But it can be given differently if the collective work agreement regulates the THR value that is better than the government's provisions," he asserted.

Aside that, entrepreneurs who were late in paying the THR would be subject to a fine of five percent of the value of the THR to be paid. But, if they did not pay it, they would get administrative sanctions.

By so, he hoped that the THR payment in 2022 could run smoothly and workers could receive their rights according to applicable regulations.

"If the company is guilty, we will propose a recommendation from the Investment and One-stop Integrated Service (PTSP) Agency to freeze the company," he stated.
